DMV Help?
I can't get into the details here but let's just say I have an issue
with the DMV concerning the purchase of my Bird. Is there anyone in
the group who can offer discreet assistance or advice concerning Ca DMV
issues?

There's a big gap between "details" and "no information"! At least a few of us
here are registered in California, but it is hard to say if we know anything
about the problem area you are experiencing. Can you narrow it down a bit
without getting to the details? Sales Tax? Clear Title? Weight? Emissions?
Safety? Something else?

When I called to ask why the license fee was so high the DMV wouldn't
tell me the value they had listed for the Bird. But they did say it
was much higher than the sale price. The license fee is over $1k.

If they came up with their own idea of what the bird is worth how did
they do it? They had no idea what kind of condition it was in when I
bought it. For all they know it could be sitting on blocks. And why
would they see the bird as different from SOB?

How do I go about contesting this perceived value?

A license fee of $1000 would indicate that they value at $150,000 (license fee
is 2/3 of 2% of value). The rules state "cost price to the purchaser as
evidenced by a certificate of cost, bill of sale, titling document, or Kelley
Blue Book"

They normally accept Bill of Sale unless they have some reason to believe it was
seriously undervalued, at which point they would go to Blue Book.

The above assumes it was purchased from out-of-state, and registered within 20
days of entering California. Penalties jack the fee progressively higher after
20 days.

The above also assumes we are truly talking about license fee, and not Use Tax;
the latter would be a minimum of 7.25%.

Contesting anything with the DMV is typically a matter for the courts, but this
is something I would contact your assembly person's office about, at least to
force an explanation.

in California? Do they go by wight? or by how old the unit is? Up
here is Washington its a goes by weight plus a standard set fee for
all car or Rv tabs. Mine went up last year from around 40 dollars to

year for your rig. Oh yes I think I paid around 1000 dollars or so
for my motor home when I change title and I claimed it at about
15,000 dollars.

There are a number of fees that makeup the California registration. The largest
when buying a vehicle is Use Tax, equivalent to Sales Tax, paid on the entire
amount with no regard for tradein. That will be a minimum of 7.25% statewide,
with various counties and districts having additional (my county has no
additional, so it is 7.25%). Assessed by location of residence.

On the annual renewal, and also on out-of-state vehicles being licensed in
California for the first time, there is VLF, vehicle license fee, of 2%, less an
"offset" of 2/3 that was going to be repealed and was the primary reason the
Guvernator got elected initially - that offset is now permanent.

The VLF drops by 10% during each year of ownership for the first 7 years, then
5% each year for 3 years, bottoming out at 15%. So that would be
0.15*0.66*purchase price, or $1 per $1000 of original price paid by current
owner who has owned it for more than 10 years.

There are small weight and registration fees that are typically a small fraction
of the others. Those fees totaled $49 on Blue Thunder's most recent
registration.

In California, annual license fees are based on (1) a flat charge for
certain "services" plus (2) a charge based on the estimated value of
the vehicle. The estimate is derived by a rather complex formula with
a decreasing value that may or may not reflect actual market value.

On transfer of a newly purchased vehicle, CA will adjust the value
(for tax purposes) to reflect the current market value. In some
cases, they may not "accept" the claimed value on a bill of sale, but
will calculate their own value based on other records.

The sales or use tax -- sales tax paid to the state through a dealer
(purchased in-state) and use tax collected by the DMV (vehicle
purchased out of state) at time of registration is a separate matter.
The sales tax varies by county, based on "overrides and special
taxing districts" -- it runs from a minimum of 7.25% and up to 8.5%
of the purchase price, if I recall correctly.

I think they have it figured out. It is not much better here. 7.25% sales/use
tax in this County, call it what you want but the annual license fee is less
than $50.00 unless you want a vanity plate which cost the same as a new
windshield. They gotta pay the payroll somehow for those folks with an arthritic
hand wrapped around the coffee cup handle. Now, the County where I live is on
to Impact Fees. Can't wait for that. I'm thinking we all need to go to Cabo.

The $1000 appears to be the "vehicle transfer fee" rather than the
sales/use tax.

If you register a vehicle in California, you have three basic fees:
Registration -- that's based on the value and age of the vehicle. It
starts at 2% for a new vehicle and through a rather complex formula
works its way down to .69% (about 2/3 of 1 percent) for an older
vehicle. The value (may be) based on the depreciated new cost of the
vehicle.

Vehicle Transfer Fee -- a one-time fee based roughly on the market
value of the vehicle at the time of the transfer. It the case that
was being discussed, the vehicle transfer fee should probably have
been in the range of $300 to $400 or so as the "market value" was
incorrectly set at $160,000 or so (for an 84 FC).

Sales/Use Tax -- this is a minimum of 7.25% ranging up to 8.25%
depending on the county where the registered owner lives or where the
vehicle was delivered if purchased in the state. If purchased from an
in-state dealer, the dealer will collect the Sales Tax based on the
net purchase price. If purchased out of state, then the use tax will
be collected by the DMV when you register the vehicle, unless the
transaction is subject to one of the (few) exceptions. You may also
get credit for any sales tax paid to another jurisdiction. For
example, if you simply move from another state to California -- and
didn't buy the vehicle recently -- then you may be exempt from paying
the use tax.
